​​​Victims of crime who suffer from physical injuries as a result of the crime may be eligible for state compensation from the Criminal Injuries Compensation Fund, to cover medical expenses, psychological counseling, partial loss of earnings, or funeral expenses that were incurred as a result of their victimization.

Qualifications for Criminal Injuries Compensation 

  • The crime occurred in Virginia and resulted in emotional or physical injury or death.
  • The crime was reported to law enforcement within 120 hours after it happened unless good cause for delay is shown.
  • The victim cooperated with law enforcement and was willing to prosecute in court.
  • The value of the claim, not paid by other sources, must be at least $100.00.
  • The crime did not involve a motor vehicle accident unless it was a result of a Hit and Run, a violation of the Drunk Driving Statute, or the injuries were intentionally inflected.

The Criminal Injuries Compensation Fund is a separate organization from the Victim-Witness Program. It is a division of the Virginia Workers' Compensation Commission and is located in Richmond, Virginia. You can call 1-800-552-4007 if you would like to speak to them directly. Please have the victim's name and claim number when you call.

Doctors, hospitals, or therapists can not file a claim on your behalf. If you are under the age of 18, a parent or guardian can file on your behalf. You can obtain a claim form from the Criminal Injuries Compensation Fund or the Victim-Witness Program. The Victim-Witness Program can provide the claim form, assist in filing a claim, and answer any questions you may have.

All Claims are judged on an individual basis.

The Victim-Witness Program CANNOT guarantee that any claim will be accepted.

As the claimant/victim you are responsible for providing all requested information to the Criminal Injuries Compensation Fund.
